Site-wide store notice hides Action menu

Can someone pls help me solve this? I have a site-wide store notice enable with text. When I'm logged in, I can see the site-wide notice and just above it is my action menu. But when I visit the site logged out, the action menu is no longer visible. Can I perhaps solve it with css?
