  So I have followed the instructions and ftp the new theme over the top of the old one overwriting any files that it asks.   It has still not fixed the issue with the menus

  Sorry but as we see, you did not updated the theme. It's still 12.7 version.

  I am having the most bizzare issues with this

  
  

  Having used Filezilla many many times to update themes for some reason this particular theme will not update

  
  

  When I look in the file structure it seems to have the theme within a theme within a theme

  
  

  It just simply will not update.   Is there anyway you are able to take a look at this for me - I am happy to supply ftp details - it makes no sense to me why it will not do this

  We are really sorry but we do not offer service like theme update or installation. You need to contact with your web developer if you are not sure how to update it. However, the only thing you should do is download latest version from Themeforest, unpack the package and replace existing files under betheme folder with the newest files from package.

  Can you advise if I switch on a different theme then go in and delete Betheme completely, then reinstall the theme, will all the data and pages etc remain as they were?

  No, you will not lose data because all settings/content/options are stored in database. However, we always recommend to do backup just in case as you never knows what wrong may happen.
